Terms

Terms of use

The ground rules for using this website. Any work we do for you is covered by its own written agreement.

Last updated: 20 October 2026

1. About these terms

This website is operated by Rubber Duck Studio, based in Christchurch, New Zealand (“we”, “us”, “our”). By using this website you agree to these terms. If you don’t agree, please don’t use the site.

2. Information on this site

The content on this site is general information about our business. It isn’t professional advice, an offer or a quote, and we may change it at any time without notice. While we try to keep it accurate and up to date, we don’t promise that it is complete, current or suitable for your needs.

3. Our services

Any work we do for you (websites, apps, software, automation or anything else) is only agreed once we both accept a written proposal, quote or agreement. That document sets out the scope, price, timing and terms of the work, and it takes priority over anything on this website. Nothing on this site, and no enquiry you send, creates a contract or obliges either of us to work together.

4. Products in development and waitlists

Products shown as “In development” are not available yet. Their names, features, availability and pricing may change, and we may decide not to launch them at all. Joining a waitlist is free, isn’t a purchase, reservation or pre-order, and doesn’t commit you or us to anything. Any future product will have its own terms of service.

5. Using the site

You agree not to:

  • use the site for anything unlawful, misleading or harmful;
  • send spam, malware or content that is offensive or infringes anyone’s rights;
  • try to gain unauthorised access to the site or its systems, or disrupt, overload or interfere with them;
  • copy, scrape or harvest content or data from the site by automated means, including to train software or AI models;
  • pretend to be someone else, or give false information through our forms.

We may block or restrict access to anyone who breaks these terms.

6. What you send us

When you contact us, you confirm the information you give us is accurate and that you’re allowed to share it. Please don’t send confidential information until we’ve agreed in writing to keep it confidential.

We work on many ideas and may already be working on, or later develop, something similar to an idea you share with us. Unless we agree otherwise in writing, sending us an idea, suggestion or feedback doesn’t create any obligation of confidentiality, payment or credit, and we are free to use general ideas and know-how without obligation to you.

7. Intellectual property

The Rubber Duck Studio name, the duck character and logos, and the design, text, graphics and code of this site belong to us or are used under licence, and are protected by New Zealand and international law. You may view and share links to the site for personal or internal business use. You may not copy, reproduce, modify or use our name, logos or content for any other purpose without our written permission.

Third-party names, logos and screenshots shown in our work belong to their owners and are shown with their permission. Some photographs are used under the Unsplash licence.

8. Links to other sites

This site may link to websites we don’t control. We aren’t responsible for their content, availability or privacy practices, and a link doesn’t mean we endorse them.

9. Availability

We provide this website “as is” and “as available”. We don’t guarantee that it will always be available, uninterrupted, secure or free of errors or viruses, and we may change, suspend or remove any part of it at any time.

10. Your rights under consumer law

Nothing in these terms limits any rights you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other law that can’t be excluded. If you use this website or our services for the purposes of a business, you agree that the Consumer Guarantees Act 1993 does not apply, as section 43 of that Act allows.

11. Limitation of liability

To the maximum extent permitted by law:

  • we exclude all warranties, guarantees and conditions about this website that aren’t set out in these terms;
  • we are not liable for any indirect or consequential loss, or for any loss of profit, revenue, business, opportunity, data or goodwill, arising from or connected with your use of (or inability to use) this website or its content, whether in contract, tort (including negligence) or otherwise;
  • our total liability to you for anything arising from or connected with this website is limited to NZ$100.

This section doesn’t apply to work we do under a separate written agreement, whose own terms govern our liability for that work.

12. Indemnity

If you break these terms or misuse the website, you agree to cover any reasonable loss, cost or claim (including reasonable legal costs) we suffer as a result, to the extent permitted by law.

13. Privacy

Our privacy policy explains how we handle personal information you give us through this site.

14. Changes to these terms

We may update these terms from time to time by publishing a new version on this page. The version in force when you use the site applies.

15. General

These terms are governed by the laws of New Zealand, and the courts of New Zealand have exclusive jurisdiction over any dispute about them. If any part of these terms is found to be unenforceable, the rest stays in force. If we don’t enforce a right straight away, we haven’t given it up.
